Sub : Suggestion for Filing application for issuance of DEPB.

In terms of Para 4.43 Handbook of Procedure Volume I (RE-02), the application for issuance of DEPB has to be made to Licencing Authority in Appendix 10-C.

At Col. No.7 of application form (Appendix 10-C) various information related to export covered under application have to be given. Following care should be taken.

Col.No.6 : In case in one invoice there are several export items, the Sr.no. of export item in the invoice should be mentioned.

Col. No.11 : FOB value required to be mentioned here is as per BRC.

It is suggested that while obtaining BRC in Col. No.14 the realised amount should be indicated in Rupee and Foreign Exchange both. 

Col. No.12 : In terms of Para 4.43 of Handbook of Procedure the FOB value realised in free Foreign Excahnge is required to be converted into Indian Rupee as per Exchange rate for export notified by Ministry of Finance applicable on the date of the order of let exports by Customs. 

Col. No.13 : Total FOB value realised in Rupee has to be multiplied by Exchange rate of Customs (Col. No.12) and FOB value realised in free Foreign Exchange as per BRC (Col. No.11).

Col. No.21 : In terms of Para 9.3 of Handbook of Procedure Vol (I), if the application is received after the last date for submission of such application but within six months from last date, the application may be considered after imposing late cut on entitlement. Vide Zonal Jt.D.G.F.T. Circular No. 1 dtd.11.06.2001 issued in Policy period 1997-2002, it was clarified that no late cut shall be imposed if the date of export / realisation in respect of atleast on Shipping Bill included in the DEPB claim is within the time period and even if all the others are outside the time period. Hence, to avoid late cut atleast one shipping bill in the claim should be filed within the time limit prescribed at Para 4.47 Handbook of Procedure. 

It is also suggested that Shipping Bills having let export date upto 31st March, 2002 should be filed separately and those having let export date 01.04.2002 onwards should be filed separately.
