HAZARDOUS CHEMICALS AND HAZARDOUS WASTE
Import licensing note
- The import policy for hazardous chemicals and hazardous waste is given below. To the extent possible, the
policy for these two groups is also given in the First Schedule. In case of any overlap or mismatch between the
policy in the First Schedule and that given below, the latter policy will prevail.
Hazardous chemicals
- Import permitted without a licence in accordance with the provisions of the Manufacture, Storage and Import
of Hazardous Chemicals Rules, 1986 [made under the Environment (Protection) Act, 1986]. Besides other conditions
mentioned in the Rules, the importer shall, before 30 days but not later than the date of import, furnish the details
specified in Rule 18 to the authority specified in Schedule 5 of the said Rules.
Hazardous waste
- Import of hazardous waste is permitted against a licence and only for the purpose of processing and reuse.
- Hazardous Wastes [Management and Handling] Rules, 1989 issued under the Environment (Protection) Act, 1986 are attracted by the import. The schedule to the said Rules lists the "wastes" covered under the restriction. The relevant extract from the schedule for goods pertaining to this chapter is given below:
- Cyanide waste
- Metal finishing waste
- Waste containing water soluble chemical compounds of lead, copper, zinc, chromium, nickel, selenium, barium and antimony
- Mercury, arsenic, thallium and cadmium bearing wastes
- Non-halogenated hydro carbons including solvents
- Halogenated hydrocarbons including solvents
- Wastes from paints, pigments, glue, varnish and printing ink
- Wastes from dyes and dye intermediates containing inorganic chemical compounds
- Wastes from dyes and dye intermediates containing organic chemical compounds
- Waste oil and oil emulsions
- Tarry wastes from refining and tar residues from distillation or prolytic treatment
- Sludges arising from treatment of waste waters containing heavy metals, toxic organics, oils, emulsions and spent chemicals and incineration ash
- Phenols
- Asbestos
- Wastes from manufacturing of pesticides and herbicides and residues from pesticides and herbicides formulation units
- Acid/alkaline/slurry wastes
- Off specification and discarded products
- Discarded containers and containers linears of hazardous and toxic waste.
