Changes in NTF. NO. 01/1995-CE, DT. 04/01/1995 & NTF. NO. 02/1995-CE, DT. 04/01/1995

In exercise of the powers conferred by sub-section (1) of Section 5A of the Central Excise Act, 1944 (1 of 1994), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby directs that each of the notifications of the Government of India in the Ministry of Finance (Department of Revenue), specified in column (2) of the Table hereto annexed shall be further amended, in the manner specified in the corresponding entry in column (3) of the said Table.

(i) in para 2, after clause (b), the following clause shall be added, namely:-

    (c) permit to remove moulds, jigs, tools, fixtures, tackles, instruments, hangers and patterns or drawings from the premises of the user industry to the premises of sub-contractors subject to the condition that the goods so removed shall be grought back to the premises of suh user industry on
(ii) in paragraph 3 for clause (a), the following clause shall be subsitituted, namely:-
    (a) the said goods used for imparting training (including commercial training) subject to the condition that the user industry imparting such training has achieved net foreign exchange earnings as percentage of exports prescribed in the Export Import Policy and that no computer terminal shall be installed outside the premises of such user industry for this purpose:
2.02/1995-CE, DT. 04/01/1995In the said notification. in Table, for serial number 2 and the entries relating thereto, following serial number and entries shall be substituted, namely:-

    (a) net foreign exchange earnings as a percentage of export less than ten percent.

    (b) net foreign exchange earnings as a percentage of exports of ten per cent or more but not exceeding twenty five per cent.

    (c) net foreign exchange earnings as a percentage of exports exceeding twenty five per cent.

Up to thirty per cent of the production in value terms of the electronic items, including components manufactured in the unit.

Up to forty per cent of the production in value terms of electronic items, including components manufactured in the units.
