General Exemptions-Export Oriented Undertakings(EOU) Gold/Silver Jewellery, Broken Stones or Dead Stock mfrd. in E0Us/EPZs for Home Consumption: Effective rates.

As amended by Notification No. 7/98-CE, dt. 2-6-1998; 30/98-CE, Dt. 8-9-1998; 1/99-CE, Dt. 4-1-199 (w.e.f. 5-1-1999);No. 38/99 and 11/2000-CE, Dt.1-3-2000.

In exercise of the powers conferred by sub-section (1) of Section 5A of the Central Excise Act, 1944 (1 of 1944), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts the goods specified in column (2) of the Table below, manufactured by a hundred per cent. export oriented undertaking or a unit in an export processing zone and allowed to be sold in India under and in accordance with the provisions of paragraphs 6.8(c) of the Export and Import Policy, 1st April, 2002 - 31st March, 2007, as amended from time to time, [OLD - in accordance with the provisions of paragraphs 8.32 or 8.26 of the Export and Import Policy, 1 April, 1997 - 31 March, 2002 ] , from so much of the duty of excise leviable thereon under Section 3 of the said Central Excise Act, as is in excess of the amount calculated at the rate specified in the corresponding entry in column (3) of the said Table.

50% of the aggregate of the duties of customs which would be leviable under the Customs Act, 1962 (52 of 1962 under any other law for the time being in force, read with any Notification for the time being in force in respect of the duty so chargeable, on like goods produced or manufactured outside India if imported into India or the duty of exciseleviable under Section 3 of the Central Excise Act, 1944 on like goods produced or manufactured in India other than in a undred percent exported oriented undertaking or an export processing zone, if sold in India, whichever is higher.

50% of the aggregate of the duties of customs which would be leviable, under Section 12 of the Customs Act, 1962 read with any notification for the time being in force, issued under sub-section (1) of Section 25of the said Customs Act, on like goods produced or manufactured outside India if imported into India or the duty of excise leviable under Section 3 of the Central Excise 1944 on like goods produced or manufactured in India or the duty of excise leviable under Section 3 of the Central Excise Act, 1944 on like goods produced or manufactured in India other than in a hundred percent exported oriented undertaking or an export processing zone, if sold in India, whichever is higher.]

[Old Provided that the amount payable in accordance with this notification shall not exceed the duty of excise leviable in terms of the provisio to sub-section(1) of Section 3 of the Central Excise Act, 1944 (1 of 1944)

[The above provisio has been inserted vide S. No. 2 of Central Excise Notification No. 38/99]

Explanation :- For the purpose of the exemption, 'dead stock' means goods which have not been exported for two years after their manufacture in the hundred precent export oriented undertaking or the unit in the export processing zone(EPZ).
