Chapter 1A - Import into India - live-stock and live-stock products shall be prohibited from all countries

S.O. (E) - In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy-2004-09, the Central Government hereby amends the ITC (HS) Classification of Export and Import Items 2004-09 as under:

1. Condition 16 of (General Notes to Import Policy) of the ITC (HS) Classifications of Export and Import items, 2004-09 shall be amended to read as under:

“16. Import into India of the following live-stock and live-stock products shall be prohibited from all countries, in view of Avian Influenza (both Highly Pathogenic Avian Influenza and Low Pathogenic Avian Influenza) :

(i) domestic and wild birds including the captive birds (excluding poultry);

(ii) unprocessed meat and meat products from Avian species including wild birds (except poultry);

(iii) semen of domestic and wild birds.

Further, the Central Government hereby prohibits also the import into India from the countries reporting Avian Influenza (both Highly Pathogenic Avian Influenza and Low Pathogenic Avian Influenza), the following live-stock and live-stock products, namely:

(i) Live poultry;

(ii) day old chicks, ducks, turkey and other newly hatched Avian species;

(iii) meat and meat products from Avian species including wild birds;

(iv) hatching eggs;

(v) eggs and egg products (except Specific Pathogen Free eggs);

(vi) feathers;

(vii) live pig and pig products (except processed pig bristles)

(Above item number (vii) under second paragraph of Condition 16 has been substituted vide
NTF NO. 50/2007, DT. 14/11/2007)

(viii) pathological material and biological products from birds;

(ix) product of animal origin (from birds) intended for use in animal feeding or for agricultural or industrial use.

However, the prohibition shall not be applicable on the import of dry processed pet food containing the ingredient of meat and meat products from Avian species, pig and product of animal origin (from birds) intended for use in animal feeding.”

2. The prohibition shall be in force till further orders.

3. This issues in public interest.
