PUBLIC NOTICE No.37/2002 Date 21.03.2002

Sub : Ministry of External Affairs Notification dated 07.02.2002

Attention of the Trade, Importers, CHAs and others concerned is invited to the Ministry of External Affairs Notification No. S.O. 189 (E) dated 07.02.2002 which was published in the official Gazette on 11.02.2002. By this notification issued in exercise of the powers conferred under clause (a) of Sub section (6) of Section 6 and clause (a) of Sub section (7) of Section 7 of the Territorial Waters, Continental Shelf, Exclusive Economic Zone and other Maritime Zones Act 1976, the Central Government has extended the Customs Act, 1962 and Custom Tariff Act, 1975 to the continental shelf of India and the exclusive economic zone of India with effect from the date of publication of the notification in the official Gazette (i.e. 11.02.2002) for the following purpose namely.

    (a) the prospecting for extraction or production of minerals oils in the continental shelf of India or the exclusive economic zone of India, and

    (b) the supply of any goods [as defined in clause (22) of Section 2 of the Customs Act, 1962] in connection with any of the activities referred to in clause (a).

The Explanation given on the said notification defines the “mineral oils” to include petroleum and natural gas for the purpose of the notification. The effect of this notification is that supply of any goods, as defined in Section 2(22) of Custom Act 1962, in connection with any of the activities referred in clause (a) of the notification in the Continental Shelf or Exclusive Economic Zone of India, shall be deemed to have been imported in to India and shall accordingly be liable to Custom duty.

NOTIFICATION

New Delhi the 7th February, 2002.

S.O. 189 (E) – In exercise of the powers conferred by clause (a) of Sub-section (6) of Section 6 and clause (a) of sub-section (7) of Section 7 of the Territorial Waters, Continental Shelf, Exclusive Economic Zone and other Maritime Zones Act, 1976 (80 of 1976), the Central Government hereby extends the Customs Act, 1962 (52 of 1962), and Customs Tariff Act, 1975 (51 to 1975) to the continental shelf of India and exclusive economic zone of India with effect from the date of publication of this notification in the Official Gazette, for the following purposes, namely :-

    (a) the prospecting for extraction or production of minerals oils in the continental shelf of India or the exclusive economic zone of India, and

    (b) the supply of any goods [as defined in clause (22) of Section 2 of the Customs Act, 1962] in connection with any of the activities referred to in clause (a)

    Explanation :- For the purpose of this notification “mineral oils” include petroleum and natural gas.
