Sub : Procedure to be followed in respect of the transmission of EDI generated Copy of B/E from Docks to MCD – reg.

Attention of all importers / CHAs and all other concerned is drawn towards EDI Public Notice No. 85/99 wherein it is ordered that Importers / CHAs shall submit all Original documents as required under the Public Notice to the concerned EDI Centre in the Docks. It is necessary to design a suitable procedure for processing , transmission and treatment to the said documents :

1. Asstt. Commissioner / Dy Commissioner incharge of EDI centre in Docks, should ensure that each and every EDI generated Customs copy of Bs/e and corresponding original import documents submitted by the importer /CHA at the time of examination , are entered in a register specially mainatained at each EDI Centre in the Docks in the following format. All those original documents will be stored in safe custody of U. D. C. Posted specially in the concerned EDI Centre.

2. Dy. Commissoiner /Asst. Commissioner, Docks incharge of jurisdictional EDI Centre shall, arrange for the original documents presented to the concerned EDI Centre, on the previous day, to be collected and transmitted on the immediate next working day to Dy / Asst. Commissioner, Post-Audit, New Custom House, Mumbai.

While forwarding , he will prepare a daily-tally sheet in duplicate on the line of prescribed format of the above register and arrange to send through special messenger, after proper scrutiny, verification and tying of all the import documents with its relative EDI generated customs copy of the B/E and out of charge order.

The aforesaid documents will be delivered to Dy. / Asstt. Commissioner, Post Audit under proper acknowledgement on the duplicate copy of the tally sheet. The duplicate copy of the tally sheet having acknowledgement on it will be stored as a permanent record in the jurisdictional EDI Centre.

3. The service centre of the EDI located in the New Custom House, Mumbai will also arrange for a weekly transmission under suitable tally sheet of all the original check-lists and other documents submitted by the Importer / CHA to the service centre of the Custom House, to Dy. / Asst. Commissioner, Post Audit.

4. Dy, / Asst. Commissioner, Post Audit will arrange for comparison and correlation of the documents received form the Service Centre of the Custom House and correlate this with corresponding original documents, Customs copy of B/E and out of charge order, received from Dy. / Asst. Commissioner, Docks.

1. After correlation Dy. / Asst. Commissioner, Post Audit will arrange to send the Customs copy of the B/E, its relative out of charge order, original invoice & B/L to micro filming centre, for micro filming.

2. After micro filming, the said documents will be received by Dy. / Asst. Commissioner, Post-Audit. The Dy. / Asst. Commissioner, Post Audit and officer –in –charge of micro filming will ensure that Micro filming of these documents is completed within 2 months from the date of assessment and out of charge order of the B/E.

3. Dy. / Asst. Commissioner, Post-Audit will then arrange for the forwarding of these original documents to CRA Audit, after micro-filming, within 1 month.

4. Thereafter, Dy. / Asst. Commissioner, Post Audit will account for the receipt of all such Bs/E and relative import documents received from CRA after its auditing. In case of any CRA objection, Dy. / Asst. Commissioner, Post Audit will arrange to send it to the concerned group for suitable action on the CRA objection and issuing protective demand Show Cause Notice within the permissible time limit under Section 28 of the Custom Act 1962 by concerned group.

5. On the last working day, of the first week of the following month all Dy. / Asst. Commissioners, incharge of Docks EDI centre, Dy. Commissioner, EDI, Dy. / Asst. Commissioner, incharge of Post – Audit, will conduct a meeting under the joint supervision of Jt. Commissioner, Docks & Jt. Commissioner, EDI with relevant information to reconcile, the B/E processed on EDI, examination of Docks delivery order, receipt of all original import documents, microfilming & its CRA audit.

If the cases are not reconciled then the appropriate report will be furnished to the Jt. Commissioner, EDI and Jt. Commissioner, Docks who will look into the matters and take necessary follow-up action for rectification & reconciliation. The report of the follow-up action of aforesaid matters & reconciliation statement prepared in the said meeting, should be submitted to the Commissioner of Custom (Import).

6. Dy. / Asst. Commissioner in charge of Post-Audit, will then arrange for forwarding of all the original documents to Dy. / Asst. Commissioner incharge of MCD under proper acknowledgement.

7. Dy. / Asst. Commissioner, MCD will then reconcile the documents so received from the Dy. / Asst. Commissioner, Post-Audit, with its corresponding IGM filed by the Steamers Agent and out-turn statement showing the details of delivery of the imported goods furnished, by the MBPT. The necessary follow-up action as may be required will be taken by Dy. / Asst. Commissioner, MCD in the similar lines to, that of the manually processed Bs/E.
