Bill of Entry-reg.

Attention of Members of Trade including Importers and Custom House Agents is invited to para 1.1 of the Public Notice No. 85/99 wherein the type of goods for which Bills of Entry shall be processed manually have been prescribed.

Increasing instances are being noticed where importers/CHAs file Bills of Entry on EDI where the consignments are expected at Mumbai port but subsequently land at CFS, Mulund or are carted to CFS, Mulund after landing. In such cases, the Bills of Entry are to be assessed under manual mode due to absence of EDI System at Mulund.

In a large number of such cases, importers/CHAs file the manual Bill of Entry after a substantial period of time during which the exchange rate/duty structure might change.

With this in view, the following procedure is being prescribed:

1. In cases where the Bill of Entry is cancelled on EDI, the Thoka number and the date of noting of the manual Bill of Entry will remain the same as that of the EDI Bill of Entry. For example, if the Bill of Entry No. 100008 dated 09-11-99 was cancelled on 15-1199, the Thoka Number for the corresponding Bill of Entry will not be generated on the LAN System but will continue to be 100008 and the date of noting will be treated as 09-11-99 only.

2. A separate register for such manual Bills of Entry has been prescribed for maintenance at the Import Deptt. Under the jurisdiction of Asstt. Commissioner(Import Noting)

3. The Group Asstt./Dy. Commr./Appraising Officer shall ensure that the signature of the Import Clerk is present on the manual Bill of Entry before assessing the same. The import clerk shall verify that the stamp of EDI Section to the effect that the EDI Bill of Entry has been cancelled is endorsed on the manual Bill of Entry before making the noting of the Bill of Entry in the register prescribed vide Standing Order No. 7497.

It is further informed that if a manual Bill of Entry is got noted without cancellation of the EDI Bill of Entry, the Importer/CHA would be liable to penal action under Section 117 of Customs Act, 1962 and/or the Custom House Agents’ Licencing Regulations, 1984 for getting two Bills of Entry noted against one IGM Line Number.
