Sub.:- Darjeeling Certification TRADE MARK PROTECTION PORCESS

Attention of Importers/Exporters/CHAs and all other concerned is invited to the guidelines laid down by the Tea Board(India) vide its letter Ref. No. 4(50)LC/2000/692 dated 11-07-2000 in respect of export of Darjeeling Tea. As per the amended Tea(Distribution and Export) Control order 2000, no exporter of Darjeeling Tea is now eligible to export tea using the name "Darjeeling" unless the following documents are obtained from the Tea Board:-

    i. Certificate of origin issued by the Tea Board in terms of Certification Trade Mark Protection Process for Darjelling Tea.

    ii. Tea Exporters Licence issued by the Tea Board.

    iii. Certificate of Trade Mark User Licence showing exporters registration with the Tea Board.

Samples of the above documents are enclosed for reference.

In fact, each consignment of shipment of Darjeeling Tea shall be supported with the Certificate of Origin and it is mandatory and statutory requirement for the production of such document by the exporter as and when required. Failure to produce such Certificate of Origin by the exporter would mean "export of non-Darjeeling Tea" and the exporter cannot use the word "Darjeeling " on the packages of the said consignment unless support by the Certificate of Origin.

It is also ordered that the concerned Export Department, shall prevent the export of tea using the word "Darjeeling" on the packages, if the consignment is not supported by a Certificate of origin and other documents issued by the Tea Board.

Subject: Darjeeling Certification Trade Mark Scheme of the Tea Board.

Sir,

I am directed to inform that the Tea Board India has officially announced its Certification Trade Mark Scheme for the word "Darjeeling" in respect of tea which is grown, cultivated, produced and manufactured in the Darjeeling Plantation District more specifically in the Scheduled tea gardens in the Darjeeling CTM Regulations. The Manual is available with the Dy. Director of tea Promotion (AR), Tea board and the same may be purchased from the Tea Board. The Price of the Manual has been fixed at Rs. 850/-.

Export of Darjeeling tea from India will henceforth be supported by two additional documents of the Tea Board. These documents are (1) Usuer’s Licence and (2) Certificate of Origin in Form BB of the Tea (Distribution & Export) Control Order, 1957 (copies enclosed).

It is, therefore, requested that necessary action may please be taken at your end and ensure full co-operation with the Tea Board in this regard.
