Sub : Movements of SMTP Containers from Docks to R.C.D. (Railway Container Depot), Cotton Green.

Attention of all Importers/CHAs/ Steamer Agents and all concerned is invited to the issue of movement of SMTP containers from Mumbai Port Trust (Docks ) to Railway Container Depot (R.C.D.) Cotton Green. Representation have been received from some concerned parties that Customs do not permit receiving of SMTP containers at R.C.D. till the SMTP documentation work is completed in Custom House, thereby increasing the congestion in Docks area. The problem stem from the fact that there has been no Bond or Bank Guarantee executed by any party ensuring safety of the goods/customs duty on the goods in the containers.

2. To sort out the issue, a meeting was held on 05.07.2002 between the Chief Commissioner of Customs, Mumbai and the Chairman, Mumbai Port Trust (MbPT). The Chairman, MbPT agreed that the MbPT will take full responsibility for the safety, security and safe receipt of the containers, and good contained in them are R.C.D. and vice versa without SMTP documents.

3. In view of the above, it has been decided to permit such movements subject to the MbPt executing a Bond with Commissioner of Customs (Import) of which taking full responsibility of such containers for movement in this stretch of road from Orange Gate- Princess Docks to R.C.D., Cotton Green. The amount of such Bond will be R.s 60 Crores to cover the duty etc. that will remain valid for a period of one year, renewable from year to year.

4. The Bond will be accepted in the Import Noting Department where the crediting /debiting and monitoring of the Bond shall be done by a designated officer. The notional value to be credited/debited from the Bond will be Rs. 6 lakhs for a 20 feet container and Rs. 12 lakhs for a 40 feet container. The Preventive Officer at the Docks Gate passing out the containers shall sign in four copies of serially numbered Gate Pass as per the proforma attached to this Public Notice certifying the passing out of the containers. The Organge Gate – Princess Docks will be the only authorised gate to permit passing out of such containers from Docks.

5. All the copies of Gate Passes will bear serially printed number. Original/duplicate/triplicate/qudruplicate copies of Gate Passes will have white /buff/pink and green colours respectively. The concerned Preventive Officers i.e. of the gates shall be responsible for the verification and maintaining records of the movements of the containers covered under Gate Passes and accountal therof. Steamer Agents have to Print Gate Passes as per the format enclosed.

6. Out of four copies of the Gate Pass, the original will be sent to Import Noting Department for recording the Container No. and debiting the Bond amount, duplicate copy will be given to the transporter for covering the transport of the container and showing it to the Preventive Officer posted at the R.C.D. gate for inward entry. The inward of the Gate Pass is to be directly sent to the R.C.D. Gate Preventive Officer and fourth copy shall be retained with the Preventive Officer at the Orange Gate – Princess docks. The Gate Pass issued at the Orange Gate shall be sent to the Import Noting Department and the R.C.D. gate on the next working day positively.

7. The Preventive Officer posted at the R.C.D. gate, on receiving the container, shall acknowledge the same on the Gate- Pass and after making necessary entries in a register (to be maintained by them ) and which will be periodically checked by the DC/P(G) shall send the 2nd copy of the pass to the Import Noting Department on daily basis, for re-crediting the notional value of the containers in the Bond.

8. The containers so received at the R.C.D.will be kept in the MbPT’s safe custody till the SMTP documentation work is completed in the Custom House and the containers are permitted to be moved to the destination ICDs/CFSs.

9. The acceptance of Bond executed by MbPT (as and when submitted and accepted ) shall forthwith be intimate by DC (Import Noting) to the DC/P(G) for issuing necessary instructions to the Preventive Officers at Docks Gate (Orange Gate- Princess Docks) and R.C.D. for implementation of this Public Notice.

10. Any problems in the implementation of this Public Notice may be brought to the notice of the Addl. Commissioner of Customs (Import).

This issues with the concurrance of Commissioner of Customs (General).
