PUBLIC NOTICE NO. 59/2003 Dated 02.06.2003

Finalisation of Assessment relating to contracts registered under Project import regulation, 1986
Attention of the Importers, Custom House Agents and other concerned is invited to

a) Notification No. 230/86-Cus. dated 03/04/1986 issued by the Government of India, Ministry of Finance, Deptt. of Revenue, New Delhi, as amended till date.

b) Public Notice No. 154/89 dated 29/11/89 issued by this Custom House, as amended upto 22/09/1995 regarding registration of contracts etc.

2. As per Regulation 7 of PIR; 86 ______ for finalisation of contract, the importer shall within three months from the date of clearance for home consumption of the last consignment of the goods or within such extended period as the proper officer may allow, submit a statement indicating the details of the goods imported together with necessary documents as proof regarding the value and quantity of goods so imported in terms of this Regulation and any other document which may be required by the proper for finalisation of the contract.

3. For the purpose of uniformity and pursuant to the request from the Trade, it has been decided that the importer shall interalia submit the following documents:

(A) Custom / Bank attested invoice (Original)

(B) Bills of Entry (Triplicate Original)

(C) Final payment certificates of the suppliers of the machinery / Bank

(D) Any other document that may be required by the proper officer for finalisation of the contract.

4. The importers may note that on their failure to comply with requirements brought out in para 2 & 3 above, the Custom House will not extend the benefit of assessment under heading no. 98.01 of the Custom Tariff and will finalise assessment of their imports on merit under the appropriate heading of C.T.A.

5. The Importer may also note that as per the directions of Central Board of Excise and Customs, New Delhi, to ensure proper utilisation of the imported goods, Plant Site Verification by jurisdictional Central Excise Authorities is required for all project contracts involving inports of Rs. 1 Crore and above (CIF). In other cases, at least 10% of the project contracts registered will be subjected to such Plant Site Verification. In view of the above the importers are required to maintain all the documents pertaining to project imports and produce the same when asked by officers deputed for Plant Site Verification.
