PUBLIC NOTICE No. - 38/2006 Date : 11.08.2006

Types of cases where manual filing of Bill of Entry (BE) & Shipping Bills (SB) may be allowed by Groups AC/DC.

All Importers, CHA’s and trading fraternity are hereby informed that the following types of cases have been identified which can not be processed in the existing EDI System. Accordingly, the Group DC/ACs have been authorized to allow manual filing of documents only in the following type of cases without referring it to Jt. Commissioner of Customs/ EDI or Asstt. Commissioner of Customs/ EDI, until further orders.

2. All cases other than the listed ones would be necessarily referred to Joint Commissioner of Customs/ EDI who would examine and decide the same on case to case basis for allowing manual filing.

LISTED CASES :
IMPORTS (BILL OF ENTRY) :


a) Diplomatic Cargo – The system charges NCCD but this is not legally correct. A reference is already made to the Board.
b) Adhoc Exemptions
c) Ex-Bond B/E where Into-Bond B/E has not been assessed in Mumbai Customs.
d) Notification 27/02 where 85% Bank Guarantee is taken.
e) Liquor Imports where 2% Education Cess on CVD is not leviable (P.N. 63 dated 20.09.04)
f) Vishesh Krishi Upaj Yojana Scheme with Tariff Value Notificaiton.
g) Levy of MRP based duty by system on all goods of CTH No. 8418 though MRP is leviable only on Refrigerators of CTH 8418 (F.No.S/1-41/2006-EDI dtd. 22.05.2006 refers).
h) Excess Cargo – At the time of examination excess cargo is noticed. At present this is being done only by filing a manual Bill of Entry for the excess cargo.
i) Import of Cars under Carnet.

EXPORTS (SHIPPING BILL) :

a) Shipstores – Liquor, Cigarettes, perfumes, etc. (as system does not accept destination as – India)
b) Deemed Exports - As system does not accept destination as – India
c) PAS Post Parcels.
d) Air India Ware House – (No EDI connectivity)
e) Re-Exports Under Section 74.
f) Carnet Exports.
g) Unaccompanied Baggage.

3. Further in the following cases where manual Bills of Entries were being allowed, will not be allowed for manual filing since EDI system can take care of such cases.

A) Bill of Entry in respect of Re-Export of Cargo required to be sent back from the Docks without taking delivery of the same and without payment of duty.

B) Bill of Entry in respect of Imports of precious or semi precious stone or articles handled by DPCC.

The importer/ CHA’s are requested to make use of this facility.
