Imports & Exports-Clearance

In exercise of the powers conferred by section 157 of the Customs Act, 1962 (52 of 1962), the Central Board of Excise and Customs hereby makes the following regulations to further amend the Courier Imports and Exports (Clearance) Regulations, 1998, namely:-

1. (i) These regulations may be called (lie Courier Imports and Exports (Clearance) Second Amendment Regulations, 1999.

(ii) They shall come into force on the date of their publication in the official gazette.

2. In (Courier Imports and Exports (Clearance) Regulations,1998 (hereinafter referred to as the said regulations),-

(i) in regulation 2, in sub-regulation (2), -

(a) in clause (b), for the figures and letters "32 Kg." the figures and letters "70 Kg." shall be substituted;

(b) in clause (e), to sub-clause (v), the following proviso shall be added, namely:-

"Provided that the limit of rupees twenty five thousand as provided in this sub-clause shall not apply to such export consignments where the G.R. Waiver or specific permission has been obtained from the Reserve Bank of India.";

(ii) in regulation 3,-

(a) in clause (c), for the words "two thousands rupees for imports", the words "five thousands rupees for imports" shall be substituted;

(b) in clause (d), -

(A)for the words"in a financial year", the words"for a consignment" shall be substituted;

(B)for the words"rupees two thousand", the words"rupees five thousand shall be substituted;

(iii) in regulation 5,for sub-regulation (5),the following sub-regulation shall be substituted,namely:-

"(5) Any imported goods which are not taken clearance, shall be detained by the Customs and shall be disposed of after issuing a notice to the Authorised Courier after the expiry of a period of thirty, days of the arrival of the said goods and the charges payable for storage and holding of such goods shall be payable by the Authorised Courier.";

(iv) in regulation 6, in sub-regulation (5), after the words ""of arrival of such goods into such area", the following words shall be inserted; namely:-

"or within such extended period as permitted by the proper officer in case of delay due to such reasons which the proper officer considers to be beyond the control of the concerned courier,";

(v) in regulation 10, in sub-regulation (1), the portion beginning with the words "provided with" and ending with the words "from time to time." shall be omitted;

(vi) in regulation 11,-

(a) for the words "five lakh rupees", the words "two lakh rupees in case of major international airports of Mumbai, Delhi, Calcutta and Chennai and one lakh rupees in case of other airports" shall be substituted;

(b) after the words "postal security", the words "or bank guarantee" shall be inserted;

3. In Form Courier Bill of Entry-IV(CBE-IV) appended to the said regulations,in "Declaration", in clause (ii), for the letters and figures "Rs.2000",the letters and figures "Rs.5000" shall be substituted.
