PUBLIC NOTICE NO.27(RE-01)/1997-200 Dt. 05/07/2001

Amendment in Handbook (Vol 1).(RE-01), 1997-2002.


In exercise of powers conferred under Paragraph 4.11 of the Export and Import Policy 1997-2002, as notified in the Gazette of India extraordinary, Part-II Section 3, Sub section (ii) vide S.O. No.283(E) dated 31.03.1997, the Director General of Foreign Trade hereby makes the following amendment in Handbook (Vol 1).(RE-01), 1997-2002.

1) Paragraph 8.75 is restored and corrected as under:

“Nominated Agencies authorised by Ministry of Commerce & Industry shall be permitted to set up showrooms/ retail outlets at the International Airports for the sale of plain and studded jewellery to foreign tourists in accordance with the procedure laid down by the Customs Authorities and shall be subject to the following conditions:
  1. All jewellery items unsold after a period of 60 days be exported abroad or returned to the respective EOU’s/ EPZ/ DTA units/ Nominated Agencies authorised by the Ministry of Commerce and Industry

  2. The minimum value addition as prescribed in the Policy shall be achieved.”

2) Paragraph 8.75(a) is restored and corrected as under:

“The Nominated Agencies shall provide the following documents to the EOU’s and EPZ/ DTA units as proof of sale/ export of jewellery items supplied by them to the nominated agencies for sale/ export at their Duty Free Shops:
  1. Statement of sold, unsold items duly countersigned by the Customs Authorities.

  2. Certificate from the Nominated Agency indicating the value of sold and unsold items of a particular parcel.

  3. Forward Inward Remittance Certificate (FIRC) indicating the value of jewellery items sold at the Duty Free Shop.

For the purpose of claiming Replenishment, the DTA unit shall submit the documents mentioned at Sl. No. (i) to (iii) above along with the following additional documents to the Nominated Agency:
(i) Original Customs attested invoice/ shipping bill

(ii) ertificate from the Nominated Agency in the form given in Appendix 15 D

3) Paragraph 10.10 (c) is added as under:

“The benefits of deemed exports under the provisions of para 10.2 (f) of the Exim Policy 1997-2002, would be granted for the supplies of goods specified in List 19, covered under categories specified in S.No 247,249 and 250 in Customs Notification No 17/ 2001 dated 01.03.2001 (read with condition nos 49, 51 and 52 of the said notification ), required in connection with petroleum operations undertaken under petroleum exploration licences or mining leases as the case may be , issued or renewed after 01.04.1999 and granted by the Government of India or any State Government to the Oil and Natural Gas Corporation or Oil India Limited on nomination basis , and petroleum operations undertaken under specified contracts including those under New Exploration Licencing Policy. These suppliers would be eligible for grant of Advance Licence for Deemed Export provided the goods are manufactured in India.”

(This para confers DEEMED EXPORT benefits to a specific mode of supply as enunciated in Public Notice No 1(FT)/DEA/2001 dated 23.05.2001 of the Department of Economic Affairs)

4) A footnote is added to Appendix 10-D pertaining to the STATEMENT OF FOREIGN EXCHANGE EARNINGS AND REDEMPTION FORM UNDER EPCG SCHEME FOR SERVICE PROVIDERS as under:

“* Column (3) of the table under g) iii) of the Appendix 10-D indicating the “Voucher No/ Invoice No” is not applicable to the hotel industry.”

5) The following additions are made in Appendix 51 pertaining to the LIST OF AGENCIES AUTHORISED TO ISSUE GSP CERTIFICATION

6) The Following Addition is made at S.No 16 under the State Head “ Maharashtra” in Appendix 51 B which pertains to the LIST OF AGENCIES AUTHORISED TO ISSUE CERTIFICATES OF ORIGIN – NON PREFERENTIAL.
