Amendments in HBP - Advance Licence monitoring strengthened

In exercise of the powers conferred under Paragraph 2.4 of the Foreign Trade Policy, 2004-09 and Paragraph 1.1 of Handbook of Procedures (Vol.1), the Director General of Foreign Trade hereby makes the following amendments and additions in the Handbook of Procedures, Vol.1, as amended.

1. The para 4.10A of handbook of procedures Vol-1 is renumbered as para 4.10.1

2. After para 4.10.1 of handbook of procedures Vol-1, following para is added

Revision of SION by ALC

4.10.2

At the beginning of financial year or any time as ALC may find it necessary, ALC may identify the SIONs which in its opinion are required to be reviewed. The exporters are required to submit revised data in the form given in ‘Aayaat Niryaat Form’ for such revision.

3. After para 4.25(iv) of handbook of procedures Vol-1, related to Physical exports, the following para is added

(v) Self certified copy of relevant portion of Appendix-23 (REGISTER FOR MAINTENANCE OF CONSUMPTION AND STOCKS OF IMPORTED RAW MATERIALS/ COMPONENTS ETC BY THE ACTUAL USERS)

4. After para 4.25 (iv) handbook of procedures Vol-1, related to deemed exports (including intermediate supplies, the following para is added

(v) Self certified copy of relevant portion of Appendix-23 (REGISTER FOR MAINTENANCE OF CONSUMPTION AND STOCKS OF IMPORTED RAW MATERIALS/ COMPONENTS ETC BY THE ACTUAL USERS)

5. After para 4.28(iv) the following para is added

“(v) the licencing Authority shall compare the self certified copy of relevant portion of Appendix-23 with that of the norms applied in a particular licence and the actual quantity imported in that licence. In this verification process, in case the licence holder has consumed lesser quantity of inputs than imported, customs duty on the unutilized value of imported material along with interest at the rate of 15% per annum thereon is payable.”

6. The Following foot note is added below Appendix-23

“Note-1:- This Register can also be maintained in electronic form. Any extract of this register can also be submitted to the Licencing Authority concerned in electronic form digitally signed .”
