Sub: Export of Sugar from the free sale quota of the year 1997-98 and 1998-99.

Attention is invited to the entry at Sl. No. 25 of Schedule 2 Appendix 1 of the book titled "ITC(HS) Classifications of Export and Import Items 1997-2002 and Policy Circular No. 2(RE-98)/98-99 dated 24.4.98 and Policy Circular No. 5(RE-98)/98-99 dated 19.5.98 on the above mentioned subject.

2. The export of Sugar under the above Policy Circulars shall also be subject to the following conditions:-

Export to USA:

The existing procedure in respect of preferential sugar export to the USA for issue of GSP certification as well as other certification requirements if any prescribed specifically for export of sugar to USA shall continue to be followed.

Export to EU:

Only ISGIEIC is authorised to effect export of white cane sugar as well as raw cane sugar to the EU and also to the USA. Therefore whatever certification is required the same will have to be made on the documents to be submitted by ISGIEIC only. In cases of EU also, there is no change in respect of GSP Certification. As regards the special Certification requirements for preferential white sugar export under European Commission Regulation No. 2782/76, the following endorsement shall be made:

    " ITEM NO.
    PREFERENTIAL SUGAR REGULATION
    NO. (EEC)2782/76" REFERES
    COMMON CODE OF SUGAR 1701"

Thus while there will not be any change in the GSP Certification for EU, the above quoted endorsement shall only be made in addition while permitting export of white sugar to the EU under the EEC Regulation No. 2782/76.

In case of export of raw sugar to the EU, which is covered under EEC Regulation No. 1916/95 dated 2.8.95, the Certification for proof of the Origin of the raw sugar exported by India to the EU shall bear the following:-

* The indication "Special preferential raw sugar - Application of Regulation (EC) No. 1916/95".
* The date of loading of the sugar and the marketing year in respect of which delivery is being made.
* The CN Code of the product in question.

The above endorsements shall not be made on consignments of jaggery or against any consignment of sugar being exported by parties other than ISGIEIC.

3. All other conditions of the Policy Circulars mentioned in Paragraph 1 above shall remain unchanged.
