DEPB Claim against Export of Bulk Drugs -Exporters to give an Affidavit

Attention is invited to DEPB rate given at S.No. 37, 38, 39 and 40 of Chemical Product as given in Annexure to Public Notice No. 10 dated 21.5.97 wherein 'Injections, Syrups, Tablets/Capsules Containing formulations or bulk drugs' have been given the specified DEPB rate.

Difficulties have been faced by the exporters as well as the Licensing Authorities while claiming/allowing the items particularly at S.No 40.

For expeditious grant of credit in respect of export product falling under S.No. 40 of the said Public Notice, it has been decided that, the exporter shall submit an Affidavit on a stamped paper as in the format given with this Circular based upon which such claims shall be finalised by the licensing authority.

This issues with the approval of DGFT.

I, ………………………………… on behalf of M/s ………………………….. hereby declare that the export product, namely …………………………..for which claim for post export DEPB/offsetting of pre export DEPB has been made by merchant exporter/us vide application No. /manual receipt No. ………………………….. against S.No. 40 of the Annexure to Public Notice No. 10/97-2002 dated 21.5.97 issued by Directorate General of Foreign Trade, is not derived from any of the bulk drugs/raw material/Intermediates listed under S. No. 37, 38 & 39 of the said Public Notice. In case, at any stage, it is found that the above declaration is not correct, I /We shall immediately refund to the extent required the entitlement claimed and received by merchant exporter/us against S. No. 40.

Note: The affidavit shall be signed by the Proprietor/Partner/Director of the exporter firm or supporting manufacturer. In case of limited company, the affidavit may also be signed by the person duly authorized by the Board of Director.
