Import of garlic against Export of garlic products under Duty Exemption Scheme

Attention is invited to Public Notice No. 36 dt. 17.9.2002 stipulating, inter-alia, that import of garlic against export of garlic product shall be issued by the Regional Licensing Authorities with

i) prior import condition, and

ii) the condition that the weight of Allicin content in import and export should match with a variation of +/-2% on the basis of Chromatographic profile of import and export item.

2. The matter was further considered in the Advance Licensing Committee (ALC), in its Meeting No. 30/03 dt. 14.11.2002. The committee observed that to curb any possibility of unauthorised diversion of duty free garlic into the domestic market, certain additional measures are required to be taken. The committee has, therefore, decided that the advance licenses for export of garlic, in addition to the conditions as above of the Public Notice No. 36 dt. 17.9.2002, will be issued by the RLAs, only to the following category of exporters:-

(a) Exporter who have exported garlic products in any of the years 2000-01 or thereafter and the

(b) Issuance of further advance licenses to such exporters may be considered only after ensuring that they have fulfilled 75% or more of the export obligation for garlic products (both quantity and value wise) in respect of their previous advance licenses.

3. The RLA would make an endorsement in the license to the effect that advance license has been issued after verifying the fact that the exporter has a past export performance of garlic products in any of the years 2000-01 or thereafter and has also fulfilled 75% or more export obligation (both quantity and value wise) in respect of his previous advance license(s) for garlic product, as the case may be, when forwarding the cases to the ALC.

4. The above instructions may be brought to the notice of all the concerned for compliance.

5. The Director General of Foreign Trade has approved the issuance of this ALC Circular.
