CUS CIR NO. 55/2003 DATE 25/06/2003

Duty drawback rates for Non-Alloy steel and Alloy steel forgings

Attention is invited to the SS Nos.73.28, 73.29, 73.30 and 73.31 of the Drawback Schedule, 2003-2004, whereby duty drawback rates have been provided for non-alloy/ carbon steel forgings, etc. and alloy steel forgings, etc., respectively.

2 Feedback has been received from the field formations that these entries are being misused by the unscrupulous exporters who are manipulating the description of the goods to derive undue higher benefits which are not intended by the Government. Therefore, in the interest of the revenue, it has been decided to delete these entries from the Duty Drawback Schedule, 2003-2004 with effect from 1st July, 2003. A notification no.42/2003-Customs (N.T.) has been issued. Thenceforth, the exporters can avail of the facility of brand rate of duty drawback in terms of rule 6 of the Customs and Central Excise Duties Drawback Rules, 1995.

3. Suitable public notices for information of the trade and standing orders for guidance of the staff may kindly be issued on the above lines.

4. The receipt of this Circular may kindly be acknowledged.

Yours faithfully,
