Customs Notification No.68/1999 dated 26th May, 1999

WHEREAS in the matter of import of Acylonitrile-butadiene rubber (hereinafter referred to as NBR)falling under sub-heading No. 4002.59 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), originating from or exported from Japan, the Designated authority vide its finalfindings, published in the Gazette of India, Extraordinary, Part I, Section I, dated the 19th October, 1995 had come to the conclusion that –

  1. exporters from Japan have sold NBR in India, below its normal value;
  2. the Indian industry has suffered material injury;
  3. the injury has been caused by the imports from Japan
AND WHEREAS on the basis of the aforesaid findings of the Designated Authority, the Central Government imposed additional duty (anti-dumping duty) vide notification No. 159/95-Customs, dated the 11th November, 1995 (G.S.R. 745(E), dated the 14th November, 1995) published in Part II, Section 3, sub-section(i) of the Gazette of India, Extraordinary, dated the 14th November,1995;

AND WHEREAS the Designated authority vide its final findings in review dated the 1st April, 1999 has come to the conclusion that –

  1. NBR originating in or exported from Japan has been exported to India below its normal value;
  2. The domestic industry would suffer material injury for dumped imports in case the anti-dumping in force is removed;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 9A of the saidCustoms Tariff Act, read with sub-section (6) of that section and rule 23 of the Customs Tariff(Identification, assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government after considering the aforesaid findings of the Designated Authority, hereby imposes on Acrylonitrile-butadiene rubber (NBR) falling under sub-heading No. 4002.59 of the First Schedule to the said Customs Tariff Act, originating in or exported from Japan, and imported into India, an anti-dumping duty at the rate of Rs. 7882/- (Rupees Seven Thousand Eight Hundred and Eighty Two only) per M.T.

2. This notification shall be in force upto and inclusive of the 13th day of November, 2001, unless it is revoked earlier.
